The requirements for data subject consent and disclosures as contained in the Protection of Personal Information Act 4 of 2013 (POPI).


A. Introduction

The Protection of Personal Information Act 4 of 2013 regulates the processing of personal information of data subjects. Thus the processing of personal information by FirstRand Limited (FSR) will be governed by POPI. POPI requires the processing of personal information to be lawful i.e. processing by consent, for a legislative reason or as required by law. It also requires certain disclosures to data subjects.


B. Proposed consent for the application form

By completing the application form you confirm and consent as necessary that FSR may process (collect, use, store or otherwise deal with) your information for the purposes of considering your application and awarding the scholarship.


C. Generic consent

I hereby confirm and consent as necessary that FSR may process (collect, use, store or otherwise deal with) my information (including processing outside of the borders of South Africa), which was voluntarily provided, for the purposes of considering my application and awarding the scholarship and requirements of the law. I hereby confirm that I have read and understood the contents of this document, specifically the portion relating to the processing of my personal information. I also confirm that the information provided by me to FSR is true, correct and current, including information about my residency and citizenship for local and international tax purposes, and that I will inform FSR if it changes.


D. Disclosures

How we use your information:

  1. Your information will be confidential and will only be processed if you consented thereto; it is necessary to conclude or perform in terms of a contract with you; the law requires it or your, our or third parties lawful interest is being protected or pursued.
  2. FSR may process your information. Information includes, amongst others, information regarding marital status, national origin, age, language, birth, education, financial history, identifying number, email address, physical address, telephone number, online identifier, social media profile, biometric information (such as fingerprints, signature or voice) and your name.
  3. The processing of information includes the collection, storage, updating, use, making available or destruction thereof.
  4. FSR may process your information for the following reasons (amongst others):
    • to comply with legislative, regulatory, risk and compliance requirements (including directives, sanctions and rules), voluntary and involuntary codes of conduct and industry agreements or to fulfil reporting requirements and information requests;
    • to detect, prevent and report theft, fraud, money laundering and other crimes;
    • to conduct market and behavioural research;
    • to develop, test and improve our offering for you;
    • for historical, statistical and research purposes;
    • to do affordability assessments;
    • to enable FSR to deliver goods or documents or notices to you;
    • for security, identity verification and to check the accuracy of your information;
    • to communicate with you and carry out your instructions and requests; and
    • for surveys.
  5. FSR may share your information with the following persons (amongst others) who have an obligation to keep your information secure and confidential:
    • law enforcement and fraud prevention agencies and other persons tasked with the prevention and prosecution of crime;
    • regulatory authorities, industry ombudsmen, government departments, local and international tax authorities and other persons that FSR under the law has to share your information with;
    • FSR’s service providers, agents and sub-contractors such as couriers and other persons FSR uses to offer and provide products and services to you; and
    • persons to whom FSR cedes their rights or delegates their obligations to under agreements.
  6. FSR can process your information outside the borders of South Africa, according to the safeguards and requirements of the law.
  7. FSR may process your information using automated means.
  8. You have the right to request us to correct or delete any information FSR has about you if it is inaccurate, irrelevant or excessive, out of date, incomplete, misleading, obtained unlawfully or no longer authorised to be kept.
  9. You may object on reasonable grounds to the processing of your information. You may not object to the processing of your information if you have provided consent or legislation requires the processing. You must inform us of your objection.
  10. You have the right to withdraw your consent which allows us to process your information, however, we will continue to process your information if permitted by law.
  11. By completing the application form you confirm and consent as necessary that FSR may process (collect, use, store or otherwise deal with) your information for the purposes of considering your application and awarding the scholarship.



E. Distribution of information

I hereby consent for my CV to be shared within the FirstRand Group for the purpose of finding a permanent position of employment. The Group undertakes to store your CV for no longer than is necessary to achieve the purpose for which it was collected and destroyed upon fulfillment of the said purpose.
